ARZPAK DMCA Policy
Effective Date: August 21, 2024
Introduction
ARZPAK (“We,” “Us,” or “Our”) respects intellectual property rights and is committed to protecting the copyrights of others. This Digital Millennium Copyright Act (“DMCA”) Takedown Policy outlines the process for reporting copyright infringement on our website (https://www.arzpak.com/) and our response to such claims.
Important Considerations Before Submitting a Takedown Notice
- Fair Use: Consider whether the allegedly infringing material constitutes fair use under U.S. copyright law. Fair use permits limited use of copyrighted material without permission for purposes like criticism, news reporting, teaching, and research.
- Legal Counsel: If you are unsure whether the material infringes your copyright, consult an attorney before submitting a DMCA takedown notice.
- Personal Information: The DMCA requires that you provide certain personal information in your takedown notice.
Reporting Copyright Infringement
To report alleged copyright infringement on our website, please submit a DMCA takedown notice containing the following information:
- Identification of the Copyrighted Work: A description of the copyrighted work you claim has been infringed.
- Identification of the Allegedly Infringing Material: A description of the location of the allegedly infringing material on our website, with sufficient detail to permit us to locate it.
- Contact Information: Your contact information, including your name, address, phone number, and email address.
- Good Faith Belief: A statement, under penalty of perjury, that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Authorization: A statement that you are the copyright owner or are authorized to act on the copyright owner’s behalf.
- Signature: Your electronic or physical signature.
Submit your DMCA takedown notice to our email.
Response to Takedown Notices
We will review all properly submitted DMCA takedown notices expeditiously and in accordance with the DMCA. If we remove or restrict access to material in response to a takedown notice, we will attempt to contact the user who posted the material and notify them of the removal or restriction.
Counter-Notices
If you believe material has been removed or access has been disabled in error, you may submit a counter-notice. The counter-notice should contain the following information:
- Identification of the removed material and the location where it was located before it was taken down.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and phone number.
- A statement that you will consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we are located, and that you will accept service of process from the person who provided the notification of copyright infringement.
Changes to this Policy
We reserve the right to modify this DMCA Takedown Policy at any time. We will notify you of any changes by posting the revised Policy on our website.
